WOO Sports Inc., (“WOO”) takes your privacy very seriously. Our goal is to provide you with a personalized online experience that includes the information, resources, and services that are most relevant and helpful to you.

 

WOO’s online and mobile services, including but not limited to the WOO website (“woosports.com” or the “Site”), widgets, computer programs and mobile applications hosted by or on behalf of WOO (collectively, the “Service”) are intended to enhance your use of the electronic monitoring products offered by WOO (“Product” or “Products”). This Privacy Policy explains how we protect personal information we collect in connection with your use of the Service, how we use, and in some cases disclose, that information. “Personal Information” for purposes of this Policy means information that identifies you, such as your name, address, phone number, gender, age, email address, or other information you provide WOO.

Read the Privacy Policy carefully. By using this Site, you will be deemed to have accepted the terms of this Policy. If you do not agree to accept the terms of the Privacy Policy, you are directed to discontinue accessing or otherwise using the Site or any materials obtained from it.

Changes to the Privacy Policy

The Privacy Policy is subject to revision at any time, without notice to users, and any changes will be effective at the time they are posted. Continued use of the Service or Product following any revision of this Privacy Policy constitutes an acceptance of any change.

What Does this Privacy Policy Cover?

This Privacy Policy covers WOO’s treatment of Personal Information that you provide to WOO in connection with your use of the Site. This Policy does not apply to the practices of third parties that WOO does not own or control, including but not limited to third party services you access through WOO, or to individuals that WOO does not employ or manage.

What Personal Information About Users Does WOO Collect?

Your Product works in conjunction with a user account on the Site (a “User Account”). You can also sync your data related to your Product with various third parties. You can alter and correct any personal information created within the Product and Service by logging into your User Account.

When you sign up for a User Account, you are required to provide your name and an email address (which will be used as your login ID), and to create an account password. This password is stored in an encrypted fashion on our systems.

  • If you elect to sign up for a User Account using your Facebook credentials, you will be asked to allow WOO to access the basic information (including your name, profile picture, gender, networks, user ID, list of friends and other public information) and certain profile information (such as your birthday) associated with your Facebook account.
  • In order to benefit fully from the Products and Service, you can also add additional personal details to your User Account, such as height, weight, gender, date of birth, profile picture, brand of sports equipment used, and location. If you are using our mobile application, these details are required as part of your registration process.
  • We collect data from the Product about the user performance such as jump height, g-force, airtime, and rotations. Information sent wirelessly from your Product to the Service is stored in your User Account. Information that you add manually to the Service is stored in your User Account. When you elect to share data from your User Account with others, we collect the information you provide about those individuals such as their name and email address.

Automatic Information

  • We collect industry standard log data about the browser and operating system you are using, the address of the external or internal page that referred you, your Internal Protocol (“IP”) address at the time of account creation, and keep an IP address log of the pages that you visit on the Service. We also collect the IP address associated with the device running the Service on your mobile device each time you sync.
  • We collect location data provided by your mobile device. You must first enable location services when you download a WOO mobile application or an updated version of the application. You can then turn location on and off within the app to activate optional features. You can opt-out of location services at any time.

Contests, Giveaways and Surveys

From time to time, WOO may offer you the opportunity to participate in contests, giveaways and other promotions. Any information submitted in connection with such activities will be treated in accordance with this Policy, except as specifically set forth in the rules for those contests, giveaways or promotions. WOO may also ask you to participate in surveys designed to help WOO improve the Service. Any personal information provided to WOO in connection with any survey will be used only in relation to that survey and as elsewhere set forth in this Policy.

What About Cookies?

The Site and Service may use “cookies” and other technologies such as pixel tags, web beacons, and mobile device identifiers, to help us recognize you when you log into our Site. By accessing the Site, you are consenting to the placement of cookies and other similar technologies in your browser in accordance with this Privacy Policy.

Cookies are alphanumeric identifiers in the form of text files that are inserted and stored by your web browser on your computer’s hard drive. “Web beacons” are images embedded in a Web page or email for the purpose of measuring and analyzing Site usage and activity. These technologies tell us which parts of our website you have visited, limit the number of times you see a WOO offer, help us better determine which WOO offers you may like to see, or alert you to software compatibility issues. They are also used to analyze and improve our Service’s design and functionality. We may use cookies in a number of ways, such as to save your password so you don’t have to re-enter it each time you visit our site, to deliver content specific to your interests and to track the pages you’ve visited. These cookies allow us to use the information we collect to customize your experience so that your visit to our site is as relevant and as valuable to you as possible. You may modify and control how and when cookies are set through your browser settings. Most browsers offer instructions on how to reset the browser to control or reject cookies in the “Help” section of the toolbar. We do not link non-personal information from cookies to personally identifiable information without your permission.

If you choose to delete cookies from your device or block them from being stored on your device, please note that the full functionality of the Service may not be available to you.

We may use third party service providers to help us analyze certain online and mobile activities and improve our products and the Service. For example, these service providers may help us measure the performance of our online campaigns or analyze visitor activity on the Site. We may permit these service providers to use cookies and other technologies to perform these services for WOO. We do not share any personal information about our customers with these third party service providers, and these service providers do not collect such information on our behalf. Our third party service providers are required to comply fully with this Policy.

Links to Third-Party Sites and Services

The Site and the Service may permit you to access or link to third party websites and information on the Internet, and other websites may contain links to the Site. These other websites and services are not under WOO’s control. The privacy and security practices of websites accessed from the Site are not covered by this Privacy Policy, and WOO is not responsible for the privacy or security practices or the content of such websites, including but not limited to the third party services you access through WOO.

Children Under 13 Years of Age

WOO is not intended for children. If you are under 18, you may use the Site and Products only with involvement of a parent or guardian. We do not knowingly collect or solicit information from, market to or accept services from children. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate the child’s account. If you become aware that your child has provided us with personal information, please contact us at support@woosports.com so we may remove the information.

What Does WOO Do With the Information Collected?

WOO does not rent or sell or otherwise distribute Personal Information that you have posted on our Site, except as permitted in this Privacy Policy.  WOO uses your information to (1) provide you with the Service; (2) analyze Site usage and improve the Service; (3) deliver to you any administrative notices and communications relevant to your use of the WOO Products and Service; (4) provide you with updates regarding WOO Products and Services; (5) perform internal market research, project planning, troubleshooting problems, and to detect and protect against error, fraud or other criminal activity; (6) enforce the WOO Terms of Use; and (7) share information with WOO identified strategic business partners.

We will not disclose Personal Information that is associated with your profile unless WOO has a good faith belief that disclosure is permitted by law or is reasonably necessary to: (1) comply with a legal requirement or process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (2) investigate and enforce this Privacy Policy; (3) respond to claims of a violation of the rights of third parties; (4) respond to member service inquiries; (5) protect the rights, property, or safety of WOO, our users, or the public; or (6) as part of the sale of the assets of WOO or as a change in control of the organization or one of its affiliates or in preparation for any of these events. WOO reserves the right to supply any such information to any organization into which WOO may merge in the future or to which it may make any transfer in order to enable a third party to continue part or all of the organization’s mission. Any third party to which WOO transfers or sells its assets will have the right to use the personal and other information that you provide in the manner set out in this Privacy Policy.

Is Information About Me Secure?

To keep your information safe, WOO employs standard industry security practices, such as firewall barriers, encryption techniques and authentication procedures, to protect all your data. Information you provide to WOO related to third party services you access through your use of the Product is protected by the privacy policies and procedures of such third party services.

When you register for the Service, WOO requires a password from you for your privacy and security. This password is stored in an encrypted fashion on our systems. You are responsible for protecting against unauthorized access to your passwords for those services and to your computer by signing off once you have finished using a shared computer.

While our aim is to keep data from unauthorized or unsafe access, modification or destructions, no method of transmission of the Internet, or method of electronic storage is 100% secure and we cannot guarantee its absolute security.

Digital Millennium Copyright Act

WOO takes reports of copyright infringement very seriously. The Digital Millennium Copyright Act (“DMCA”) outlines the statutory requirements necessary for formally reporting copyright infringement, as well as providing instructions on how an affected party can appeal a removal by submitting a compliant counter-notice. WOO thoroughly investigates complaints received. WOO’s response to notices of alleged copyright infringement may include the removal or restriction of access to allegedly infringing material. If WOO removes or restricts access to user content in response to a notice of alleged infringement, WOO will make a good faith effort to contact the affected user with information concerning the removal or restriction of access, including a copy of the takedown notice, along with instructions for filing a counter-notification.

Governing Law

This Privacy Policy is governed by the laws of the Commonwealth of Massachusetts, United States of America without giving any effect to the principles of conflict of law.

California Privacy Rights

 

California Civil Code Section 1798.83 permits customers who are California residents and who have provided WOO with “personal information” as defined in Section 1798.83 to request certain information about the disclosure of information to third parties for their direct marketing purposes. What to do in the Event of Lost or Stolen Information
